CHASKA TOURS SAS acts as an intermediary between users and entities or individuals involved in providing transportation, accommodation, meals, and other services contracted through CHASKA TOURS SAS. CHASKA TOURS SAS agrees to fulfill the confirmed services, with exceptions explained in these conditions, and is not responsible for errors by such entities in implementing their obligations. CHASKA TOURS SAS is also not liable for damages due to strikes, weather conditions, delays, earthquakes, quarantine, material or personal injury, damage, loss of luggage, damages resulting from accidents, illnesses, or deaths. Users must claim damages directly from the companies that provided inadequate services. CHASKA TOURS SAS acts as an intermediary in such cases. These terms and conditions are governed by civil and commercial law, as well as other relevant laws.

PRICES

Price changes are reserved due to changes in the costs of each individual element or exchange rate fluctuations. Value-added tax does not apply to foreign customers eligible for this exemption. To qualify for the exemption, passengers should indicate "leisure and recreation" (ocio, vacaciones, turismo) as the purpose of travel when questioned by the immigration officer at the airport or another border entry point. The officer stamps the passenger's passport with the PIP 5 stamp. Different stamps or different travel purposes reported to the immigration officer may invalidate the exemption for the passenger. In this case, Chaska Tours SAS and any other tourism service provider must collect value-added tax on the price paid by the customer for each service.

DOCUMENTATION

All passengers must carry the required personal documents. The travel agency assumes no responsibility for information, withdrawal, or denial of visas.

GENERAL DATA PROTECTION REGULATION

These are the conditions and responsibilities that apply to us as a tour operator regarding the processing of personal data of citizens from European Union countries (such as name, birthdate and place, nationality, gender, passport, phone, email, bank details), for maintaining the business relationship, executing the requested services, billing, and after-sales service.

Purpose of data processing: The aforementioned personal data are exclusively used for the purpose of executing tourist services requested by the interested party. This data is not disclosed to third parties unless necessary to ensure the provision and billing of the contractually agreed-upon tourist services.

Chaska Tours SAS will maintain confidentiality regarding personal data to which it has access under this contract (contract and payment for tourist services), even after the contract's termination.

Rights of data owners: Data owners have the right to access, correct, delete, and port their data during the time Chaska Tours SAS and/or its employees have stored them. To exercise any of these rights, data owners can contact Mr. Rene Suter at info@chaskatours.co.

Data storage: The aforementioned personal data will be stored and protected by the personnel responsible for Chaska Tours SAS and deleted two years after the service's termination date. Employees must commit to proper storage and deletion after the mentioned period to ensure their security and confidentiality.

CANCELLATIONS, CHANGES, AND REFUNDS

Up to 15 days before the start of the trip (21 days if the start is during peak season), the customer can withdraw from the contract and the provision of requested services. CHASKA TOURS SAS charges a cancellation fee of 15% of the total contract value for administrative costs unless the contract specifies otherwise.

If the contract is canceled between 15 and 7 days before the trip (20 to 15 days if the start is during peak season), CHASKA TOURS SAS charges a cancellation fee of 50%, unless the contract specifies otherwise.

If the contract is canceled 7 days before the trip (or 14 days for trips starting in peak season) or if the traveler fails to use the services ("No show"), no refund will be provided unless the agreed-upon contract terms state otherwise.

Changes to the name, travel date, or services desired by the traveler after the confirmation of the travel plan will be individually handled by the representative of CHASKA TOURS SAS responsible for customer care. CHASKA TOURS SAS does not charge additional fees for change requests, except for those imposed by the hotel/airline or another company, and those resulting from the difference between the originally agreed-upon and the changed services.

SEASONS

Low season: Travel between February 1 and November 30, excluding Easter, July 1 to September 1, and local holidays that may vary depending on the destination.

For travel dates in peak season, please inquire about prices and service availability before booking.

NOTES ON FLIGHTS AND OTHER SPECIAL SERVICES

CHASKA TOURS SAS acts as an intermediary between the customer and the airline for the purchase of airline tickets, if desired. Once the airline tickets are booked, confirmed, and paid for by the customer, the services are subject to the airline's change, cancellation, and/or refund policy with which the flights were contractually agreed upon, not the cancellation policy described in the previous title "CANCELLATIONS."

The same applies if the traveler books services through CHASKA TOURS SAS with special change, cancellation, and/or refund conditions (such as a minimum stay requirement or a cancellation fee different from the one mentioned in the previous title "CANCELLATIONS"). In this case, the representative of CHASKA TOURS SAS will inform the customer of the special provisions applicable to them during the reservation and confirmation of the services, and the services will be confirmed after the customer's approval.

In any case, the cancellation of flights, hotels, or other services booked and/or pre-paid through us is subject to the cancellation conditions of the hotel/airline or another contracted company. If these conditions specify a specific cancellation fee, it will be charged regardless of the percentage CHASKA TOURS SAS charges as a cancellation fee for each individual case.

CONCORDANCE

By applying for inclusion in a travel program marketed by CHASKA TOURS SAS, the customer and/or passenger declares that they understand and agree to all points of these General Terms and Conditions, as well as all conditions mentioned in the travel plan. Speculative, false, or fraudulent reservations are not allowed. As a customer, you must be of sufficient age to legally use this medium and accept the legal and financial obligations associated with it. You agree that you are aware of all responsibilities arising from the use of CHASKA TOURS SAS services.

The information, products, and other services published by CHASKA TOURS SAS may contain inaccuracies and typographical errors. CHASKA TOURS SAS, its service providers, and employees regularly update information changes. As a condition for using our services, the customer guarantees that no unlawful or prohibited activities under the above-mentioned conditions and requirements will be conducted.

CHASKA TOURS SAS:

- Is not responsible for consequences due to war, strikes, theft, epidemics, quarantine, weather, or other fates and circumstances beyond our control while the passenger uses our services.
- Reserves the right to change the travel itinerary and/or

 individual hotel bookings to ensure the safety of passengers and the smooth operation of the tour in the event of unforeseen circumstances.
- Acts only as a representative of the owners and operators of hotels, transportation companies, attractions, and other service providers.
- Reserves the right to change hotels mentioned and booked in the program to equivalent or higher-category hotels if circumstances require it.

Chaska Tours SAS adheres to Law 1336 of 2009 and Resolution 3840, supplementing Law 679 of the Congress of the Republic, in which provisions for the prevention and combat of exploitation, pornography, and sex tourism with minors were published. According to these principles, we must prevent, block, track, and report all exploitation, use, publication, and distribution of images, texts, documents, audiovisual documents, and the use of global information networks related to pornography and sex with children.

Colombian law applies.

Prices and availability of services are subject to change without prior notice.

Chaska Tours SAS adheres to Law 1336 of 2009 and Resolution 3840, supplementing Law 679 of the Congress of the Republic, in which provisions for the prevention and combat of exploitation, pornography, and sex tourism with minors were published. According to these principles, we must prevent, block, track, and report all exploitation, use, publication, and distribution of images, texts, documents, audiovisual documents, and the use of global information networks related to pornography and sex with children.

Chaska Tours SAS is subject to the liability regime of Law 300 of 1996, Decree 53 of 2001, Law 1101 of 2006, Decree 2438 of 2010, and other regulations, specifying its function as an intermediary travel agency.

Chaska Tours SAS commits to sustainable tourism in accordance with Law 17 of 1981 and Law 1333 of 2009, which aims to prevent the illegal trade of flora and fauna species, as well as Laws 63 of 1986, Law 1185 of 2008 on the illegal traffic of cultural assets, Law 2811 of 1973 on the National Code for renewable natural resources and environmental protection, Law 0584 of 2002, declaring endangered species in the country, and Law 379 of 1997, General Cultural Law, respecting the information about various attractions and activities related to the cultural and natural heritage of the country.
